ORDINANCE NO. 88 – 1

 

            AN ORDINANCE PROHIBITING THE DEPOSITING OF SNOW, ICE, OR MUD MORE THAN 3 FEET INTO THE PUBLIC STREET AS MEASURED FROM THE EDGE OF THE STREET, AND PROVIDING PENALITIES FOR THE VIOLATION THEREOF.

 

 

            WHEREAS, the depositing of snow, ice, or mud onto City owned streets creates traffic hazards as well as additional expenses for Helper City in removing the same,

 

 

            NOW THEREFORE,

 

 

            BE IT ORDAINED by the City Council of Helper City, A Municipal Corporation of the State of Utah;

 

 

Section I

 

 

            It shall be unlawful for any person, firm, or corporation to place, transfer, or deposit any snow, ice, or mud more than three feet into any public street as measured from the edge of the street.

 

 

Section II

 

 

            Any person, firm, or corporation violating any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than $299.00 or imprisonment for not more than 6 months in the County Jail, or both such fine and imprisonment, at the discretion of the Court.

 

 

Section III

 

 

            In the opinion of the City Council, it is necessary for the preservation of peace, health, and safety of the City that his Ordinance shall become effective immediately upon its being posted in three public places as required by law.
