The regular meeting of the Helper City Council was called to order by Mayor Mike Dalpiaz at 6:00 p.m.
APPROVAL OF MINUTES
January 17, 2008
Council Member Jones moved to approve the corrected
minutes of January 17, 2008. Council Member Mascaro seconded the motion.
Motion Carried. Ganser, Jensen,
Mascaro, Armstrong and Jones all voting yes.
MIKE JAMES AND SUMMER
MCBRIDE ON HELPER CAR SHOW.
Mike James told the council that the car show was being advertised for the Father’s Day, June 14, 2008. Mayor Dalpiaz informed the council that there is also an American Legion Tournament that has reserved the park. The council felt that both events could happen and will work with both parties to work this out. Roger Metzger will be working on a cruise for June 13, 2008. Mr. Metzger told the council that the cars would be going up and down Main Street then stopping at the Clamper Hall for burgers and hot dogs. Mr. Metzger is also looking into getting a big screen for the Rio Theater to show the movie American Graffiti. The council thanked both men for having this wonderful event.
CAROLYN TURNER AND
DELORES SLAVENSKY ON THE CONDITION OF MARTIN ROAD.
Ms. Slavensky addressed the council on some of the issues on Martin Road. The road needs more than patching with all the new traffic on the road now. Plowing is a big issue right now for safety there is only one lane. 10th North is very dangerous. Carolyn Turner told the council that the oil on the road is almost gone and if people park on the road at the pond there is no room to turn the corner at 10th North. Karla Jones stated that 10th North needs some sand the road is very unsafe. Mrs. Jones also told the council that when the big trucks park in the turn out by 10th North you can not see the traffic coming from the North. Pam Reddington has problems on 6th North for RV’s coming to her RV Park. The snow needs to be removed from the road there is no room for the RV’s to get in and out. Richard Miklovic had an issue with all of the W.W. Clyde trucks coming up the road at least 50 trucks in one day. Several of the Martin residents complained about the merge lane off Highway 6 being unsafe and the turn was too sharp. Council Member Jones told the residents that he would address their concerns on Highway 6 with U.D.O.T. Mayor Dalpiaz told the residents that the city crews have been doing the best that they can. Pot holes are impossible to fix right now they are trying to fill with cold mix but with the water in the holes the mix will not stay in the hole. The council told the residents that they would do what they could for them and will get back with them on their issues.
CARL ALLRED ON
PLOWING THE ROADS.
Mr. Allred was not in attendance. Mayor Dalpiaz explained the snow ordinance that had been posted on the back of the utility bills. Ordinance 88-1 states that no more than three feet of snow can be deposited into the city street from your property line. Mayor Dalpiaz told the residents present to let everyone know that ordinance will be enforced.

APPROVAL ON VANCON CONTRACT ISSUES FOR THE NORTH MAIN WATER AND SEWER PROJECT.
Council Member Jones explained the problems that he has been having with Vancon on the North Main Project. Council Member Jones told the council that he had met with Vancon, U.D.O.T and Stanley Consultants and decided to give Vancon six additional days to complete the project. Vancon must get out of the U.D.O.T construction zone by this time and then we can negotiate how long the City will give them to complete the project and this may include penalties. The council did not have a problem as long as we have something in writing.
Council Member Jones moved to approve the letter on
January 30th from Stanley Consultants to Vancon subject to
adjustments and/ or negotiations by Council Member Jones and Attorney Strate
with final approval from council. Council Member Mascaro seconded the motion. Motion Carried. Ganser, Jensen, Mascaro, Armstrong and Jones all voting yes.
DISCUSSION AND/OR
APPROVAL ON DISABILITY ACT.
Attorney Strate told the council that he had been talking with Alison Draper and all we need to do is get a plan together to fix these problems. Mayor Dalpiaz told Attorney Strate and Council Member Armstrong to get a list together. Council Member Jensen volunteered to help with the list.

APPROVAL ON STATE PROCESS FOR LIBRARY.
Council Member Armstrong moved to support the Library Board
in their state planning process.
Council Member Mascaro seconded the motion. Motion Carried. Ganser,
Jensen, Mascaro, Armstrong and Jones all voting yes.
DISCUSSION AND/OR
APPROVAL ON CONTRACT FOR SCENIC BYWAYS GRANT.
Attorney Strate had no problem with the contract, but was concerned about the cities funds for the matching money. Council was wondering if the other grant monies would qualify for the match. Council Member Jensen felt that the city had the money to match the grant.
Council Member Armstrong moved to sign the agreement for
the scenic byway grant. Council Member
Mascaro seconded the motion. Motion
Carried. Ganser, Jensen, Mascaro,
Armstrong and Jones all voting yes.

APPROVAL ON SNOW REMOVAL.
This was discussion was covered in agenda item 3.
UNFINISHED BUSINESS:
(A) SOLAR LIGHT FOR
BILLBOARD:
Council Member Mascaro is stilling looking into the solar lighting.
(B) CARPET FOR 69
SOUTH MAIN.
Attorney Strate explained that we had advertised the entire property for sale and that made it hard to fight. However, the Molinars are only paying taxes on the property not our building. Mayor Dalpiaz will talk to the Molinars on the issue.
(C) BOYACK
RIGHT-A-WAY.
Mayor and Attorney Strate are still working on an agreement.
(D) KEY BANK LEASE.
Attorney Strate told the council that Key Bank is interested
in buying the property.
The council would like to put the property out to bid. Attorney Strate told the council that the lease is not up until 2009 and he will contact Key Bank and see what kind of offer they will make.
(E) POWER FOR NORTH
MAIN INTERCHANGE.
Council Member Jones and Ganser will be
working on this.
(F) COMBINING PUBLIC
SAFETY RESOURCES WITH CARBON COUNTY.
Council Member Armstrong is still researching this option. Council Member Armstrong told the council that he had asked for volunteers to help evaluate the needs of the community and no one contacted him. Chief Anderson suggested to Council Member Armstrong to do a ride around with a police officer to better understand what the police do for the community.

Council Member Mascaro moved to go into an executive session. Council Member Armstrong seconded the
motion. Motion Carried. Ganser, Jensen, Mascaro, Armstrong and Jones
all voting yes.

voting yes.
