The Public hearing of
the Helper City Council was called to order by Mayor Bonacci at 5:30 p.m.
Tom Boyack began the discussion by asking the council if anyone had found an ordinance changing the original zone to residential. Mayor Bonacci replied that nothing was found on that property but did find the ordinance adopting the current zoning map. Mr. Boyack then showed the council his plans for the property along with some maps. Mr. Boyack pointed out that currently a warehouse that exists on the property has been used as a storage shed. Mr Boyack plans to build storage units on the property if it is rezoned. Mr. Boyack presented pictures of surrounding property owners and the property itself showing how unattractive it currently is. Council Member Farrell pointed out that this is spot zoning and is not recommend by experts to do. Greg Payne was concerned about what type of business could come in if the property was sold and is zoned commercial. Mr. Payne was also concerned about property values around the storage units. Mrs Llewelyn stated that in Price around Walmart the property value is low and hard to sell. Mr. Boyack felt that the rezone would increase the value of the surrounding properties. Mr. Boyack pointed out that Mr. Payne has a commercial business within a resential area. Mayor Bonacci asked if the residents would consider a mixed zone? Jim Callor did sign the paper that Mr. Boyack brought around. Mr. Callor has changed his mind and would not like to have storage units across from him. Tino Guttierrez brought up a noise issue when people go in and out of the units. Mrs. Llewelyn was also concerned about the traffic on the road and children walking. Mr. Boyack expressed concern with Council Member Farrell voting, knowing that his brother owns storage sheds. Council Member Farrell assured Mr. Boyack that had not crossed his mind.
Mayor Bonacci closed the public hearing and opened the special meeting.
DISCUSSION AND/OR
APPROVAL ON ORDINANCE NO. 2004-7 AMENDING THE ZONING MAP, CHANGING R-1 5000 TO
GC-1 AT THE SOUTH END OF BRYNER STREET.
Council Member Buchanan would have liked more information from the planning and zoning commission other than the letter from the planning and zoning. Mr. Buchanan also did not like the idea of spot zoning. Council Member Farrell was not for spot zoning but pointed out that spot zoning, is not illegal, but not a good idea. Council Member Farrell told the council that he felt that this was a great idea if it was in a different area.
Council Member Welch moved to reject Ordinance 2004-7 amending the zoning map. Council Member Buchanan seconded the motion. The Council roll call vote is as follows: Council Members Buchanan, Farrell, Welch, Mascaro in favor Gonzales voting no Ordinance 2004-7 was rejected.
ADJOURNMENT:
There being no further business Council Member Mascaro moved to adjourn the meeting. Council Member Welch seconded the motion. Motion carried. Unanimous decision by council present to adjourn the meeting.
