The regular meeting of the Helper City Council was called to order by Mayor Mike Dalpiaz at 6:00 p.m.
APPROVAL OF MINUTES July
19, 2007
Council Member Buchanan moved to approve the minutes July
19, 2007. Council Member Mascaro seconded the motion. Motion Carried. Unanimous
decision of the Council present.
K.C. WILLIAMS ON
FLOODING AND GRAVEL PIT.
K.C. Williams approached the council on flooding issues at his home on 115 West 10th North. Attorney Strate looked over the problem, but was not sure if the ditch was the problem or the location where the gravel pile was located or both. Mr. Williams told the Mayor that it was the ditch across the street by the Utah Power substation was plugged. Mr. Williams felt that Helper City maintains the road, so they should be maintaining the ditch. Council Member Jones asked Mr. Williams about his driveway, retaining wall and drain pipe. Mr. Williams had installed the driveway, retaining wall with a 2 ½” drain pipe and felt that would sustain any rainfall. Mayor Dalpiaz explained there were several places that had been flooded from this very unusual rainfall. Johnny Pappas told the council that the water was sheeting over the road from the land where the gravel pile had been due to lack of vegetation and grading. The surface is so hard it is like asphalt and the water is just running over the top and crossing the road. Council Member Armstrong stated that the change in flow of the water was changed due to the activity on private property and this may be a civil action. Mayor Dalpiaz asked Mr. Williams what he wanted the city to do. Mr. Williams reply was to help him with the drainage problems before he gets flooded out. Mayor Dalpiaz stated the city will check the crown on the road and get the ditches clean, if they belong to us. Council Member Jones suggested replacing the cement in front of the home and adding curb and guttering on the 60/40 plan. Mayor Dalpiaz instructed Attorney Strate to do a title search to find out who owns the road, ditches etc. Then the city crews will do whatever has to be done as far as cleaning the ditches and fixing the crown on the road.
HELPER ARTS
COUNCIL/ARTS FESTIVAL ON PARK NAMES.
Mary Lou Dornan gave the council an update on the Maynard and Mozart Concert that will be held at the Rio Theater on October 13. Melanie Steele asked the council if the Main Street Park could be renamed and the council suggested several names. There was some question on whether or not the park name could be changed due to the requirements of the deed to the park. Marie Davidson thought that the park name had to have something about the railroad in it because of a grant that was given to the Helper Development Committee. Attorney Strate will review the deed from the Helper Development Committee to see if there are any stipulations on a name for the park.

APPROVAL ON BUSINESS LICENSE FOR VON CORBETT MAINTENANCE AT 110 HILL STREET.
Mayor Dalpiaz asked Mr. Corbett if this was a handyman license or maintenance contractor. Mr. Corbett will be doing jobs for under $1,000 so the license will be a handyman license.
Council Member Jones moved to approve business license
for Von Corbett Handyman license.
Council Member Mascaro seconded the motion. Motion Carried. Unanimous decision of the Council present.

APPROVAL ON PURCHASING COMPUTER FOR COURT IN THE AMOUNT OF $856.
Council Member Jones moved to approve the purchase of a new computer for the court in the amount of $856. Council Member Mascaro seconded the motion. Motion Carried. Unanimous decision of the Council present.

APPROVAL ON PURCHASING COMPUTERS FOR POLICE DEPARTMENT ON GRANT IN THE AMOUNT
OF $3500.
Council Member Jones moved to approve the purchase the new computers for the police department on a grant in the amount of $3500. Council Member Mascaro seconded the motion. Motion Carried. Unanimous decision of the Council present.
DISCUSSION AND/OR
APPROVAL ON ORDINANCE 2007-03 REQUIRING ALL RESIDENTS TO HAVE SERVICE
CONNECTIONS.
The intent of the council is any person that occupies a residence for one day must maintain all service connections.
Council Member Jones moved to approve Ordinance 2007-03 requiring all residents to have service connections. Council Member Buchanan seconded the motion. The council roll call vote is as follows: Council Members Buchanan, Mascaro, Armstrong and Jones all in favor Ordinance 2007-03 passed by unanimous roll call vote.

APPROVAL ON RAISE FOR LARRY MARINONI, WATER DEPARTMENT.
Council Member Armstrong moved to approve a dollar raise
for Larry Marinoni in the water department.
Council Member Mascaro seconded the motion. Motion Carried. Unanimous
decision of the Council present
DISCUSSION AND/OR
APPROVAL ON SWIMMING POOL PROJECT
Council Member Armstrong update on pool project and the discussions with Westland on the final construction phase.

There being no further business Council Member Buchanan moved to adjourn. Council Member Mascaro seconded the motion. Motion carried. Unanimous decision by the council present to adjourn the meeting.
