AN ORDINANCE AMENDING THE HELPER CITY POLICE POLICIES MANUAL TO PROVIDE FOR THE UTAH CRIMINAL HISTORY DISSEMINATION – RIGHT OF ACCESS.
BE IT ORDAINED BY THE CITY COUNCIL OF HELPER CITY, UTAH:
The
following provisions are hereby added to the Helper City Police Policies
Manual:
1100.00 Purpose:
Allowing for any citizen with residency in Carbon
County requesting to review their own (UCCH) criminal history through the
application process with the Helper City Police Department.
1100.01
Procedures:
1.
Citizen Application Process
a.
Any
person requesting to review their UCCH must complete an application in person which
provides the subjects date of birth, social security number, full legal name, place
of residency, and requestors signature.
No batch inquires will be allowed.
b.
UCCH
print out will only be given to the requester in person and who has positively
identified him/herself by providing either a valid State Driver’s License or
State Identification Card, or passport.
2.
Right of Access Purpose Code:
a.
“P”
will be used for the purpose code when running any Right of Access request.
3.
Dissemination of UCCH for Right of Access to any requester:
a.
A
photo copy of the requestor’s valid identification provided, Helper Police
Department application, and receipt of payment will be attached together and
filed in the dissemination log file created for each year.
b.
Every
Page of the Rap Sheet will be stamped with a Helper City Police Department
stamp which includes the date.
c.
The
requestor will be informed that the Rap Sheet is only valid for the date in
which it was printed from Helper City Police Department, therefore making the
Rap Sheet outdated daily.
d.
The
requestor will be advised that any incorrect data or missing data must be taken
to BCI so the information can be corrected.
4.
Fee for Right of Access thru Helper City Police Department:
a. $10.00 will be charged for any person receiving a UCCH thru Helper City Police Department for Right of Access.
5.
Misuse of UCCH/Right of Access:
a. Helper City Police Department will conduct an investigation into any complaint or allegation filed involving the misuse of the criminal history files/Right of Access. BCI will also be notified of any allegation or complaint that our agency receives.
b.
Any
Helper City Police Department employee found in violation of any policy
relating to UCCH or Right of Access will be reprimanded according to Helper
City Personnel Policies and Procedures.
6.
Helper City Police Department Employees allowed to run Right of Access:
a.
Helper
City Police Department Chief of Police
b.
Helper
City Police Department Sergeant
c.
Helper
City Police Department Coordinator
THE CITY COUNCIL HEREBY DIRECTS THAT THESE PROVISIONS BE INSERTED IN THE OFFICIAL COPIES OF THE HELPER CITY POLICE POLICIES MANUAL IN THE OFFICE OF THE CITY RECORDER AND POLICE DEPARTMENT.
THIS
ORDINANCE SHALL TAKE EFFECT UPON ITS PASSAGE AND POSTING AS REQUIRED BY LAW.
